ORDINANCE 2026-04

ORDINANCE OF THE BOROUGH OF SHIP BOTTOM, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING CHAPTERS 13.04 OF TITLE 13 OF THE BOROUGH CODE OF THE BOROUGH OF SHIP BOTTOM ENTITLED “WATER SERVICE SYSTEM” AND 13.08 OF TITLE 13 OF THE BOROUGH CODE OF THE BOROUGH OF SHIP BOTTOM ENTITLED “SEWER SERVICE SYSTEM”  SO AS TO REVISE THE RATES FOR THE WATER AND SEWER SERVICE SYSTEM

             BE IT ORDAINED, by the governing body of the Borough of Ship Bottom, County of Ocean, State of New Jersey, as follows:

SECTION I

Subsection 13.04.030B, B1, B2, and B8 of Chapter 13.04 of the Borough Code of the Borough of Ship Bottom entitled “Rates, Fees and Charges” are repealed and replaced as follows, B3-7 and B11 and B12 shall remain, and B10 is amended to replace the provision “There shall be a minimum fee of $62.50 per quarter for each residential dwelling” with “There shall be a minimum fee of $92.50 per quarter for each residential dwelling.”

A. Rates, Fees and Charges. The following rates, fees and charges shall be made and collected for the services and facilities of the comprehensive water system, commencing the service year of 2026:
1.Flat fee for single dwelling unit, whether contained in single-family residence, duplex apartment, condominium, or other multifamily or project: $500.00;

2.For each additional dwelling unit, whether contained in a duplex, apartment, condominium or other multifamily structure or project: $500.00;

3.Commercial property flat fee: $475.00.

SECTION II

Subsection 13.08.010F, F1, F2, and F6 of Chapter 13.08 of the Borough Code of the Borough of Ship Bottom entitled “Rates, Fees and Charges” are repealed and replaced as follows and F3-F5 and F7-14 shall remain.

B. Rates, Fees and Charges. The following rates, fees and charges shall be made and collected for the services and facilities of the comprehensive sewerage system commencing the service year 2026:

1.Flat fee for single dwelling unit, whether contained in single-family residence, duplex, apartment, condominium or other multi-family structure or project: $550.00.
2. For each additional dwelling unit, whether contained in a duplex, apartment, condominium or other multi-family structure or project: $550.00.
3. Commercial property flat fee: $550.00.

SECTION III

            All ordinances, or parts of ordinances, inconsistent with this ordinance are hereby repealed to the extent of such inconsistency. 

SECTION IV

            If any word, phrase, clause, section, or provision of this ordinance shall be found by any Court of competent jurisdiction to be unenforceable, illegal, or unconstitutional, such word, phrase, clause, section, or provision shall be severable from the balance of the ordinance and the remainder of the ordinance shall remain in full force and effect.

Effective date.

            This ordinance shall take effect after final adoption and publication as required by law.

NOTICE

Public Notice is hereby given that the foregoing Ordinance was introduced and passed on the first reading at a regular meeting of the Mayor and Council of the Borough of Ship Bottom, County of Ocean, State of New Jersey, held on Tuesday, February 24, 2026, at 6:30 p.m.

Further public notice is hereby given that said ordinance shall be considered for final passage and adoption at a regular meeting of the Mayor and Council to be held on March 24, 2026, at 6:30 p.m. at the Municipal Building, 1621 Long Beach Boulevard, Ship Bottom, New Jersey 08008.
